This Privacy Notice for Live Commerce Agency LLC (doing business as 6-Figure Creator) ("we," "us," or "our") describes how and why we access, collect, store, use, and share ("process") your personal information when you use our services ("Services").

6-Figure Creator is an educational membership community for content creators. We provide training, digital content, coaching, and community access through our websites and third-party platforms. We sell memberships and event tickets through our checkout provider, operate a private Discord community, send email and SMS communications to members who opt in, coordinate the fulfillment of promotional product samples, and host in-person and virtual events. This Privacy Notice applies to all of these activities, including our websites at 6figurecreator.org and all related subdomains.

We receive information from our payment platform, from Discord when you authenticate with our member applications, from Growi where you have opted in to share your creator performance data, and from our advertising and analytics providers. How do we process your information? To provide and administer our Services, communicate with you, market our products, prevent fraud, and comply with law.

Do we sell or share your information? We do not sell personal information for money. We do share certain information — online identifiers, transaction events, and browsing activity — with advertising and analytics providers for targeted advertising. This is defined as "selling" or "sharing" under certain US state privacy laws, and you may opt out. See Section 12.

What are your rights? Depending on where you live, you may have rights to access, correct, delete, or obtain a copy of your personal information, and to opt out of targeted advertising. See Sections 10 and 12.

1. What Information Do We Collect?

Personal information you provide to us

We collect personal information you voluntarily provide when you purchase a membership or event ticket, register with our member applications, request product samples, respond to a survey, attend an event, or contact us. This may include:

  • Names
  • Email addresses
  • Phone numbers
  • Mailing addresses (for product sample fulfillment)
  • Usernames and social media handles
  • Discord user IDs and account identity information
  • Contact and communication preferences
  • Authentication data associated with our member applications
  • Event registration and attendance information
  • Content and submissions provided through our member applications
  • Survey and questionnaire responses, including creator performance information you choose to provide
  • Photographs, video, and audio recordings captured at our events

Sensitive information. We do not process sensitive personal information.

Payment information. Payments are processed by Whop, including where our checkout is embedded on our websites. We do not collect, receive, or store your payment card number, expiration date, or security code. We receive transaction records from Whop, such as the product purchased, the amount, the date, and your subscription status. Whop's privacy notice is available at https://whop.com/privacy/.

Information collected automatically

We automatically collect certain information when you visit or use our Services. This information does not by itself reveal your identity, but may include:

  • Log and usage data. Service-related, diagnostic, usage, and performance information our servers record in log files, including IP address, device information, browser type and settings, pages viewed, and actions taken.
  • Device data. Information about the computer, phone, tablet, or other device you use, including IP address or proxy server, device and application identification numbers, browser type, hardware model, internet service provider or mobile carrier, operating system, and system configuration.
  • Location data. Approximate location derived from your IP address. You can limit this by adjusting your device settings, though some features may not function as intended.
  • Advertising and attribution data. Click identifiers, campaign parameters, referral sources, and conversion events collected through advertising and analytics platforms.

Information collected from other sources

We receive information about our members from the following sources:

  • Our payment and membership platform (Whop) — purchase, subscription, and transaction records.
  • Discord — account identity information, including username, user ID, and email address, when you authenticate with our member applications.
  • Growi — creator performance and sales data, where you have signed up with Growi and opted in to share that data with us. We do not provide member information to Growi.
  • Our advertising and analytics providers — campaign, conversion, and attribution data relating to visits to our websites.

We do not purchase personal information from data brokers, and we do not acquire marketing lists from third parties.


2. How Do We Process Your Information?

We process your personal information for the following purposes:

  • To facilitate account creation and authentication. So you can access and use our member applications and private community.
  • To deliver our Services. To provide the training, content, coaching, and community access you purchased.
  • To fulfill and manage your orders. To process and manage memberships, event tickets, payments, and cancellations.
  • To fulfill product sample requests. We use your name and shipping address to coordinate the fulfillment and delivery of promotional product samples.
  • To provide access to our community and applications. We use Discord account information to grant and manage access to our private community and member applications.
  • To manage event registration and attendance. To admit attendees, manage check-in, and administer our events.
  • To enable member-to-member communication. Through our community platforms.
  • To respond to inquiries and provide support.
  • To send administrative information. Including billing notices, access changes, service updates, and changes to our terms and policies.
  • To send marketing and promotional communications. Where you have opted in. You can unsubscribe at any time.
  • To deliver targeted advertising. To display advertising relevant to your interests on other platforms.
  • To determine the effectiveness of our marketing campaigns.
  • To identify usage trends. To understand how our Services are used so we can improve them.
  • To request feedback. Through surveys and questionnaires.
  • To administer contests, giveaways, and community challenges. We process your information to verify eligibility, validate entries, determine winners, and announce results.
  • To defend against payment disputes and chargebacks. We process your information to provide transaction records, access logs, timestamps, communications, and accepted purchase terms to our payment processor when a dispute is filed.
  • To protect our Services. Including fraud monitoring, security, and prevention of abuse.
  • To comply with legal obligations. Including tax, accounting, and responding to lawful requests.

3. What Legal Bases Do We Rely On?

If you are located in the EU or UK

The EU and UK GDPR require us to explain the lawful bases we rely on to process your personal information. We rely on the following:

  • Performance of a contract. To deliver the membership, community access, product samples, and event admission you purchased, and to manage billing and support.
  • Consent. For marketing and promotional email and SMS communications, and for targeted advertising. You may withdraw consent at any time.
  • Legitimate interests. To analyze how our Services are used so we can improve them; to measure the effectiveness of our marketing; to diagnose problems and prevent fraud; to administer contests and challenges; and to defend against payment disputes.
  • Legal obligations. To comply with tax and accounting requirements, to cooperate with law enforcement or regulators, and to exercise or defend legal claims.
  • Vital interests. Where necessary to protect the safety of any person.

If you are located in Canada

We process your information where you have given express consent, or where consent can reasonably be inferred. You may withdraw your consent at any time. In limited circumstances permitted by law, we may process information without consent — for example, for fraud detection and prevention, to comply with a subpoena or court order, or where the information is publicly available and specified by regulation.


4. When and With Whom Do We Share Your Personal Information?

We share personal information with third-party vendors, service providers, and contractors who perform services on our behalf and require access to do that work. We have contracts in place designed to safeguard your personal information.

The categories of third parties we share personal information with are:

  • Payment processors
  • Communication and messaging platforms
  • Sales, marketing, and customer relationship management tools
  • Cloud computing, hosting, and data storage providers
  • Website and product analytics providers
  • Ad networks and retargeting platforms
  • Affiliate marketing programs
  • Order fulfillment and product sample suppliers
  • Finance and accounting providers
  • Professional advisors, including legal counsel
  • Government entities, where required by law

We may also share your personal information in the following situations:

  • Business transfers. In connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business.
  • Legal obligations and rights. Where required to comply with applicable law, a subpoena, a court order, or a lawful request from public authorities, or where necessary to protect our rights, safety, or property, or those of others.
  • With your consent. For any other purpose disclosed to you at the time.

Mobile information. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing with subcontractors providing support services, such as customer service, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with third parties.


5. Do We Use Cookies and Other Tracking Technologies?

We use cookies and similar tracking technologies — including web beacons, pixels, and tags — to gather information when you interact with our Services. Some of these technologies are necessary to maintain security, prevent errors, save your preferences, and support basic site functions.

We also permit third parties and service providers to use tracking technologies on our Services for analytics and advertising, including to measure campaign performance, tailor advertisements to your interests, and attribute conversions. These third parties use their own technology to deliver advertising that may appear on our Services or on other websites.

The tracking technologies we use for advertising and analytics include:

  • Targeting and marketing cookies
  • Beacons, pixels, and tags
  • Click identifiers and redirects used for conversion attribution

To the extent these technologies are deemed a "sale" or "sharing" of personal information under applicable US state laws, you can opt out as described in Section 12.

Google Analytics. We share information with Google Analytics to analyze use of our Services. The Google Analytics Advertising Features we may use include Demographics and Interests Reporting and Remarketing. You can opt out of Google Analytics tracking at https://tools.google.com/dlpage/gaoptout, and manage Google advertising preferences through Google Ads Settings. Browser controls. Most web browsers accept cookies by default. You can set your browser to remove or reject cookies. If you do, some features of our Services may not function properly.


6. Is Your Information Transferred Internationally?

Our servers are located in the United States. Regardless of where you are located, your information may be transferred to, stored, and processed in the United States and in other countries where our service providers operate.

If you are a resident of the European Economic Area, the United Kingdom, or Switzerland, these countries may not have data protection laws as comprehensive as those in your own country. We take measures to protect your personal information in accordance with this Privacy Notice and applicable law.

Standard Contractual Clauses. We rely on the European Commission's Standard Contractual Clauses for transfers of personal information from the EEA and UK to our third-party service providers. These clauses require recipients to protect personal information originating from the EEA or UK in accordance with European data protection law. Copies can be provided on request.


7. How Long Do We Keep Your Information?

We retain personal information for as long as necessary to provide our Services, maintain your membership history, comply with tax, accounting, and legal obligations, resolve disputes, and enforce our agreements.

Where you remain a member, we retain your information for the duration of your membership. Following cancellation, we retain membership and transaction records for the period reasonably necessary for the purposes above, and we may retain certain records for longer where required for legal, tax, or dispute-resolution purposes.

You may request deletion of your personal information at any time as described in Section 15. Where we have no ongoing legitimate business need to process your personal information, we will delete or anonymize it, or, where that is not possible — for example because it is held in backup archives — securely store it and isolate it from further processing until deletion is possible.


8. How Do We Keep Your Information Safe?

We have implemented appropriate and reasonable technical and organizational security measures designed to protect the personal information we process. However, no electronic transmission over the internet or information storage technology can be guaranteed to be completely secure, and we cannot promise that unauthorized third parties will not defeat our security and improperly access or modify your information. Transmission of personal information to and from our Services is at your own risk. You should only access the Services within a secure environment.


9. Do We Collect Information From Minors?

We do not knowingly collect data from or market to children under 18 years of age, nor do we knowingly sell such personal information. By using the Services, you represent that you are at least 18, or that you are the parent or guardian of a minor and consent to that minor's use of the Services.

If we learn that we have collected personal information from a person under 18, we will deactivate the account and take reasonable measures to promptly delete that data from our records. If you become aware of any data we may have collected from a child under 18, please contact us at support@6figurecreator.org.

Where a parent or legal guardian registers a minor to attend one of our events, we collect only the information necessary to admit and supervise that attendee, subject to the consent requirements described in our Terms of Service.


10. What Are Your Privacy Rights?

Depending on your state of residence in the US, or if you are located in the European Economic Area, United Kingdom, Switzerland, or Canada, you may have rights that give you greater access to and control over your personal information.

These may include the right to request access to and obtain a copy of your personal information; to request correction or erasure; to restrict processing; to data portability; and not to be subject to automated decision-making. In certain circumstances you may also object to processing. To make a request, email support@6figurecreator.org.

Withdrawing your consent. Where we rely on your consent, you may withdraw it at any time by contacting us. This will not affect the lawfulness of processing carried out before withdrawal, or processing carried out on another lawful basis.

Opting out of marketing communications. You can unsubscribe at any time by clicking the unsubscribe link in our marketing emails, by replying "STOP," "UNSUBSCRIBE," or "CANCEL" to our text messages, or by contacting us at support@6figurecreator.org. You will be removed from our marketing lists. We may still send you service-related messages necessary for the administration of your membership.

Account information. If you would like to review, change, or terminate your account, contact us at support@6figurecreator.org. On request, we will deactivate or delete your account and information from our active databases. We may retain some information to prevent fraud, troubleshoot problems, assist investigations, enforce our legal terms, or comply with legal requirements.

Complaints. If you are located in the EEA or UK and believe we are processing your personal information unlawfully, you have the right to complain to your Member State data protection authority or, in the UK, to the Information Commissioner's Office (ico.org.uk/make-a-complaint). If you are located in Switzerland, you may contact the Federal Data Protection and Information Commissioner. We ask that you contact us first at support@6figurecreator.org so we can try to resolve the matter. We will acknowledge a complaint within 30 days, investigate without undue delay, and explain the outcome.


11. Controls for Do-Not-Track Features

Most web browsers and some mobile operating systems include a Do-Not-Track ("DNT") feature you can activate to signal your preference not to have your online browsing activity monitored. No uniform technology standard for recognizing and implementing DNT signals has been finalized. We do not currently respond to DNT browser signals. If a standard is adopted that we must follow, we will update this Privacy Notice.

California law requires us to disclose how we respond to DNT signals. Because there is currently no industry or legal standard for recognizing or honoring them, we do not respond to them at this time.


12. Do United States Residents Have Specific Privacy Rights?

If you are a resident of California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, or Virginia, you may have the right to request access to and details about the personal information we maintain about you, to correct inaccuracies, to obtain a copy, or to delete it. You may also have the right to opt out of targeted advertising and the sale or sharing of your personal information.

We retain the personal information in Categories A, B, D, F, G, and H for as long as necessary for the purposes described in Section 7.

We may also collect other personal information outside these categories where you interact with us in person, online, by phone, or by mail — for example when receiving support, participating in surveys or contests, or attending our events.

Disclosure and sale or sharing of personal information

In the preceding twelve months, we disclosed the following categories of personal information to third parties for a business purpose: Category A (Identifiers), Category B (California Customer Records), Category D (Commercial information), Category F (Internet or network activity), Category G (Geolocation data), and Category H (Audio, electronic, sensory information).

In the preceding twelve months, we sold or shared the following categories of personal information: Category A (Identifiers), Category D (Commercial information), Category F (Internet or network activity), and Category G (Geolocation data). The categories of third parties to whom we sold or shared this information are ad networks, retargeting platforms, and data analytics services.

We do not sell personal information for money. We share online identifiers, transaction events, and browsing activity with advertising and analytics providers so that advertising can be targeted and measured. This activity meets the definition of "selling" or "sharing" under certain US state privacy laws, which is why it is disclosed here. We do not sell or share the names, mailing addresses, or telephone numbers of our members with advertising platforms, and we have not sold personal information belonging to anyone we know to be under 16 years of age.

Your rights

These rights are not absolute, and in some cases we may decline a request as permitted by law. They include:

  • The right to know whether we are processing your personal data
  • The right to access your personal data
  • The right to correct inaccuracies
  • The right to request deletion
  • The right to obtain a copy of the personal data you previously shared with us
  • The right to non-discrimination for exercising your rights
  • The right to opt out of targeted advertising, the sale or sharing of personal data, and profiling with legal or similarly significant effects

Depending on your state, you may also have the right to obtain a list of the categories or specific third parties to which we have disclosed personal data, the right to limit the use of sensitive personal data, and the right to question how personal data has been profiled.

How to exercise your rights

To exercise any of these rights, including to opt out of the sale or sharing of your personal information or of targeted advertising, email support@6figurecreator.org with your request. Please include the email address associated with your account so that we can locate your information.

You may also limit tracking by adjusting your browser settings to reject cookies, and by using the Google Analytics and advertising opt-out tools described in Section 5.

Authorized agents. You may designate an authorized agent to make a request on your behalf. We may deny a request from an agent who does not provide proof of valid authorization.

Verification. We will need to verify your identity before acting on a request. We will use the personal information provided in your request only to verify your identity or authority. If we cannot verify your identity from the information we already hold, we may ask for additional information.

Appeals. If we decline to act on your request, you may appeal by emailing support@6figurecreator.org. We will respond in writing with our decision and the reasons for it. If your appeal is denied, you may submit a complaint to your state attorney general.

California "Shine the Light" law. California Civil Code Section 1798.83 permits California residents to request, once a year and free of charge, information about the categories of personal information we disclosed to third parties for their direct marketing purposes, and the names and addresses of those third parties. To make such a request, contact us using the details in Section 14.


13. Do We Make Updates to This Notice?

We may update this Privacy Notice from time to time. The updated version will be indicated by a revised "Last Updated" date. If we make material changes, we will notify you either by prominently posting a notice of the changes or by sending you a direct notification. We encourage you to review this Privacy Notice periodically.
